These Terms and Conditions apply to the use of this website and purchases made from Jessica Jubb Jewellery.

By accessing this website or placing an order, you agree to these Terms and Conditions. Please also read our Privacy Policy, Returns Policy, and Shipping and Delivery Policy.

1. About this website

This website is operated by Jessica Jubb Jewellery, based in Perth, Western Australia.

The online store is hosted by Shopify, which provides the ecommerce platform used to display and sell our products. Purchases made through this website are made directly from Jessica Jubb Jewellery.

2. Products

Jessica Jubb Jewellery creates artist-made jewellery using a combination of hand fabrication, etching and traditional metalworking processes.

We make reasonable efforts to describe and photograph each piece accurately. Because of the handmade and small-production nature of the work, slight variations may occur between individual pieces. These may include variations in surface finish, colour, pattern placement, dimensions and other details arising through the making process.

Colours may also appear differently depending on your screen and device settings.

These variations are not considered faults where they are consistent with the product description and the handmade nature of the work. Nothing in this section limits your rights under Australian Consumer Law if a product is faulty, damaged or materially different from its description.

3. Product availability

Products may be available as completed pieces, made in small production runs or made to order.

Any applicable production time will be shown on the product page. Made-to-order pieces will generally be posted within the timeframe stated when the order is placed.

We may change or discontinue products and limit available quantities at any time. If we are unable to fulfil your order, we will contact you and provide an appropriate refund.

4. Prices and payment

All prices are displayed in Australian dollars. Any applicable taxes are included in the displayed price unless clearly stated otherwise.

Shipping costs are calculated at checkout and shown before payment is completed.

Payment must be received before an order is processed. Payments are handled securely through Shopify and the payment providers offered at checkout. Jessica Jubb Jewellery does not directly store your complete payment-card details.

5. Orders

When you place an order, you are offering to purchase the selected products subject to these Terms and Conditions.

An order confirmation acknowledges that the order has been received. We may contact you if additional information is required before the order can be completed.

We reserve the right to decline or cancel an order where:

  • a product is unavailable;
  • payment has not been authorised;
  • incorrect pricing or product information has been displayed;
  • we reasonably suspect fraudulent activity; or
  • we are otherwise unable to fulfil the order.

If payment has already been received for an order we cannot fulfil, the applicable amount will be refunded to the original payment method.

Please check your order details carefully before completing payment.

6. Changes and cancellations

If you need to correct or cancel an order, please contact mail@jessicajubb.com as soon as possible.

An order may not be able to be changed or cancelled once production or shipping preparation has begun, particularly where the piece is made to order, customised or commissioned.

Your rights in relation to faulty, damaged or incorrectly supplied products are not affected by this section.

7. Shipping and delivery

Orders are shipped from Perth, Western Australia.

Production and estimated delivery timeframes are provided as a guide. Delivery may be affected by postal services, customs processing or circumstances outside our reasonable control.

Jessica Jubb Jewellery remains responsible for providing an appropriate solution where an order is not supplied, is lost in transit or arrives damaged, in accordance with Australian Consumer Law.

Please refer to our Shipping and Delivery Policy for preparation times, delivery estimates, tracking, international shipping and customs information.

8. Returns and refunds

Change-of-mind returns are handled in accordance with our Returns Policy.

Some made-to-order, customised and commissioned pieces may not be eligible for change-of-mind returns. Any relevant restriction will be stated on the product page and in the Returns Policy.

This does not limit your rights where a product is faulty, damaged, unsafe, incorrectly supplied or materially different from its description.

Our goods come with guarantees that cannot be excluded under Australian Consumer Law. Depending on the circumstances, you may be entitled to a repair, replacement, refund or other remedy.

9. Materials and care

Information about materials, finishes, natural oxidation, surface treatments and recommended care is provided on the product page and in our Materials and Care information.

Jewellery may change through wear, handling and exposure to the environment. Natural oxidation, gradual patination and the wearing of surface finishes are not necessarily manufacturing faults.

Care instructions should be followed to help preserve the condition of the work. This does not limit your rights in relation to a product that does not meet the consumer guarantees under Australian Consumer Law.

10. International orders

International customers are responsible for any customs duties, import taxes or other charges imposed by the destination country.

These charges are not included in the product or shipping price unless expressly stated at checkout.

Customers are responsible for checking any import restrictions that may apply in their country.

11. Intellectual property

Unless otherwise stated, all jewellery designs, photographs, artwork, text, graphics, branding and other original content on this website are owned by Jessica Jubb.

Website content may not be copied, reproduced, distributed, modified, published or used for commercial purposes without prior written permission.

Purchasing a piece of jewellery does not transfer copyright or other intellectual-property rights in its design.

12. Website information

We make reasonable efforts to keep product descriptions, prices, availability and other website information accurate and current.

Occasionally, the website may contain an error or omission. We may correct inaccurate information when identified. If an error affects an order you have placed, we will contact you before proceeding wherever reasonably possible.

Nothing in this section permits us to avoid our obligations under Australian Consumer Law.

13. Third-party services and links

This website may use or link to services provided by third parties, including Shopify, payment providers, postal services and social-media platforms.

Your use of a third-party service may also be subject to that provider’s terms and privacy practices. Jessica Jubb Jewellery is not responsible for content or services provided independently by third-party websites.

This does not limit any responsibility that cannot lawfully be excluded.

14. Privacy

Personal information is handled in accordance with our Privacy Policy.

Because this store is hosted by Shopify, information required to operate the store and process transactions may also be collected and processed by Shopify and relevant service providers.

15. Acceptable use

You must not use this website:

  • for an unlawful or fraudulent purpose;
  • to interfere with the security or operation of the website;
  • to transmit malicious software;
  • to infringe another person’s intellectual-property or privacy rights; or
  • to collect information from the website through unauthorised automated means.

We may restrict access to the website where reasonably necessary to protect the store, its customers or its services.

16. Liability

To the extent permitted by law, Jessica Jubb Jewellery is not responsible for indirect or consequential loss arising from use of this website.

Nothing in these Terms and Conditions excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under Australian Consumer Law.

These Terms and Conditions may be updated when the website, business practices or applicable requirements change.

The current version will be published on this page with the date of the most recent update. Terms applying to a purchase will be those available when the order was placed, except where a change is required by law.

18. Governing law

These Terms and Conditions are governed by the laws of Western Australia and the applicable laws of the Commonwealth of Australia.

Any dispute will be subject to the jurisdiction of the courts and tribunals of Western Australia, subject to any rights a consumer may have under applicable law.
